CuttingAge Partner Terms & Guidelines

These Partner Terms & Guidelines (“Terms”) apply to all organizations and individuals (“Partners,” “you”) who submit programs, services, resources, or events for listing on the CuttingAge platform in the United States. By submitting content or creating a partner account, you agree to be bound by these Terms.

CuttingAge is operated from the State of New York and is intended primarily for U.S.-based organizations and audiences.

1. Acceptance of Terms

By submitting content, creating a partner profile, or otherwise using CuttingAge's partner features, you confirm that you:

  • Have the authority to agree to these Terms on behalf of your organization, and
  • Have read, understood, and agree to comply with them.

If you do not agree, you must not submit content or use our partner features.

2. Accurate and Complete Information

You are responsible for ensuring that all information you submit is truthful, complete, and current, including:

  • Program or service descriptions,
  • Locations and service areas,
  • Schedules and availability,
  • Costs and fees,
  • Eligibility criteria, and
  • Contact and participation instructions.

You agree to promptly correct or update your information if it becomes inaccurate, incomplete, or outdated.

3. Respectful, Senior Safe, and Clear Content

You agree that all content you submit will:

  • Be respectful, non-discriminatory, and appropriate for older adults, caregivers, and families.
  • Not be misleading, fear-based, exploitative, harassing, or high-pressure.
  • Use clear, plain language that is reasonably understandable to the general public, avoiding unnecessary jargon or exaggerated claims.

You will not make promises, guarantees, or outcome claims that you cannot reasonably support.

4. Services, Credentials, and Legal Compliance

You agree to describe only services, credentials, licenses, certifications, and affiliations that are accurate, current, and not misleading. If any such status changes (for example, a license expires or is revoked), you will promptly update or remove the related claims.

If you provide health, legal, financial, housing, transportation, caregiving, or other regulated services, you are solely responsible for complying with all applicable U.S. federal, state, and local laws, rules, and professional standards in the jurisdictions where you operate.

CuttingAge does not provide legal, medical, financial, or other professional advice and does not verify your regulatory compliance.

5. Privacy, Permissions, and Sensitive Information

You will not submit private, confidential, or sensitive personal information about any individual unless you have all necessary rights, consents, and authorizations under applicable law. This includes photos, testimonials, documents, and other materials that identify real people.

You represent and warrant that you have obtained any required written consents and permissions to submit such content and to grant CuttingAge the license described in Section 8.

6. Prohibited Conduct: No Scams, Spam, or Deceptive Promotion

You agree not to use CuttingAge to:

  • Submit false, deceptive, or materially incomplete information.
  • Hide material terms or fees that would be important for users to know.
  • Engage in scams, fraudulent offers, or unsafe services.
  • Submit duplicate or substantially duplicative listings meant to manipulate visibility.
  • Send spam, unsolicited bulk communications, or other abusive marketing.

CuttingAge may suspend or terminate your partner access and remove content it reasonably believes violates this section.

7. Accessibility and Inclusion

You agree to make reasonable efforts to support accessibility and inclusion consistent with applicable laws (for example, the Americans with Disabilities Act and similar state or local requirements).

When possible, you will include information about accommodations such as physical accessibility, language support, virtual options, transportation assistance, or other relevant supports.

8. Review, Moderation, and License to Use Content

All submissions are subject to review and moderation. CuttingAge may, in its sole discretion, edit for clarity and formatting, categorize content, decline to publish, or remove content that does not meet its standards for quality, safety, accuracy, or trust.

By submitting content, you grant CuttingAge a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify (for formatting and display), publish, distribute, and display your content in connection with the CuttingAge platform, communications, and related services. You represent that you have all rights necessary to grant this license.

9. "As Is" Platform; Limitation of Liability

CuttingAge and its owners, officers, employees, and contractors provide the platform, listings, and related services “as is” and “as available,” without any express or implied warranties, including implied warranties of merchantability, fitness for a particular purpose, or non‑infringement, to the fullest extent permitted by law.

To the fullest extent permitted by law, CuttingAge's total aggregate liability arising out of or relating to these Terms or the platform is limited to the greater of: (a) the total amount, if any, that you paid to CuttingAge for partner services in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars (USD 100).

CuttingAge will not be liable for any indirect, incidental, special, consequential, or punitive damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless CuttingAge and its owners, officers, employees, contractors, and agents from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your submissions or content,
  • Your programs or services,
  • Your violation of these Terms, or
  • Your violation of any applicable law or third-party rights.

11. Termination

CuttingAge may suspend or terminate your partner account, remove or disable access to any content, and restrict your use of the platform at any time if it believes you have violated these Terms or engaged in conduct that may harm older adults, caregivers, other users, or CuttingAge.

Upon termination, CuttingAge may retain and use your content as reasonably necessary for recordkeeping, compliance, or archival purposes, but is not obligated to continue displaying it.

12. Changes to These Terms

CuttingAge may update these Terms from time to time. When we do, we may update the effective date below and, where required, provide additional notice. Your continued use of partner features after updated Terms are posted constitutes your acceptance of them.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of New York and applicable federal laws of the United States, without regard to conflict of law principles.

You agree that any legal action or proceeding arising out of or relating to these Terms or the platform will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction and venue of those courts.
